Chauffeur-Driven Transport Booking Terms

Document key: chauffeur_transport_v1 Version: 1.0.0 Effective date: 2026-05-28

DRAFT — pending legal review. Counsel review required before launch, particularly Section 8 (driver as independent contractor) and Section 4 (surge / dynamic pricing disclosures per CCPA Dark-Pattern Guideline 2023).

These Chauffeur Transport Terms apply, in addition to the Booking Terms, to every chauffeur-driven transport booking on the Prayana platform: airport transfer, intracity ride, intercity ride, hourly chauffeur, package tour, and similar.

1. The driver

The driver is an independent contractor engaged by the Operator (the fleet partner), not by Prayana. The Operator is responsible for the driver's background verification, licence (commercial driver's licence appropriate to the vehicle class), training, conduct, and fitness to drive.

REVIEW: counsel required before launch — confirm driver-as-contractor framing holds under your specific Operator arrangements; aggregator vs employer status has Motor Vehicle Aggregator Guideline 2020 and labour-law implications.

2. Vehicle and assignment

2.1 You book a vehicle category (e.g. compact, sedan, SUV, tempo traveller). The specific vehicle and driver are assigned shortly before pickup and displayed in the app.

2.2 Where the assigned vehicle category is unavailable at pickup, the Operator will upgrade you to the next available category at no extra cost or, at your choice, cancel for a 100% refund.

3. Pickup, waiting, and route

3.1 The driver waits up to:

  • 60 minutes free for airport pickup (international arrivals; from flight-actual-landing time);
  • 45 minutes free for airport pickup (domestic arrivals);
  • 15 minutes free for any other pickup.

After the free window, a waiting charge applies (displayed at checkout).

3.2 The driver follows the route shown on the GPS unless you instruct otherwise. Material detours add to the distance and may be chargeable (displayed before commencement).

4. Pricing, surge, and disclosures

4.1 Pricing is shown upfront at checkout: base fare, per-km charge (if applicable), waiting charges, toll, parking, and any dynamic / surge component, separately itemised.

4.2 Surge or dynamic pricing, where applicable, is shown before you confirm and is binding for that booking. We do not retroactively change the price.

4.3 Tolls, parking, state-entry permits, and inter-state taxes are passed through to you and itemised on the final bill. Some Operators include them in the displayed price; the listing tells you which.

4.4 Tips to the driver are voluntary.

5. Safety

5.1 All vehicles are GPS-tracked. The Prayana app shows you the live trip on map and exposes an SOS button that, when triggered, alerts Prayana safety operations, the Operator, your emergency contact (if set), and (where needed) law-enforcement.

5.2 Seatbelts are mandatory for every occupant on intercity and highway trips. Children below 4 feet require a booster seat (you can request one at checkout, subject to Operator availability).

5.3 Smoking and consumption of alcohol or any intoxicant in the vehicle is prohibited.

6. Cancellation

6.1 Free cancellation up to 60 minutes before the pickup time for airport transfers and intercity trips, 15 minutes before for intracity trips, except where the listing publishes a different policy.

6.2 No-show at pickup (driver waited the full window and you did not show or respond): full forfeiture of the base fare; remainder refunded.

6.3 Driver-initiated cancellation, vehicle no-show, or service failure: 100% refund.

7. Customer obligations

7.1 You must provide accurate pickup and drop addresses, contact number, and flight / train PNR (for airport / station pickups).

7.2 You must conduct yourself reasonably toward the driver; harassment, verbal abuse, or threats are grounds to terminate the trip with no refund and may result in account suspension.

7.3 Soiling of the vehicle (vomit, spill of liquid, pet hair beyond brushing) may attract a cleaning charge (₹500 – ₹2,500 depending on extent), itemised with photographic evidence.

8. Liability

8.1 The Operator and its driver are liable for the safe and lawful conduct of the trip and for compliance with the Motor Vehicles Act, 1988 and the Motor Vehicle Aggregator Guidelines, 2020.

8.2 The vehicle is insured with third-party + passenger cover as required by the Motor Vehicles Act. Operator insurance covers passenger injury within statutory limits.

8.3 Prayana facilitates the booking. Prayana's own liability is capped as set out in Section 9 of the Platform Terms of Use.

9. Privacy and GPS

Live location and post-trip GPS logs are processed and retained as set out in the Privacy Policy. For chauffeur trips the GPS log is retained for 90 days unless required longer for incident investigation or law-enforcement request.

10. Operator and Prayana roles

The Operator is the contracting party for the vehicle and the driver. Prayana facilitates the booking and payment.
