Holiday Package Booking Terms

Document key: package_booking_tnc_v1 Version: 1.0.0 Effective date: 2026-05-28

DRAFT — pending legal review. Counsel + CA review required before launch, especially Sections 5 (taxes incl. TCS), 6 (visa), 9 (cancellation).

These Holiday Package Booking Terms apply, in addition to the Booking Terms, to every Holiday Package you book on the Prayana platform (domestic or overseas).

1. Scope of a Holiday Package

A "Holiday Package" is a multi-day itinerary that may include any combination of: transport (intercity, intracity, airport transfers), accommodation, meals, activity inclusions, guide services, sightseeing tickets, and visa-processing assistance. The exact inclusions for your package are displayed on the listing and itemised on your booking voucher.

2. Inclusions and exclusions

2.1 You are booking exactly what the listing describes as "Inclusions". Items marked "Exclusions" are not part of the price (e.g. personal expenses, tips, laundry, room-service meals, travel insurance, visa fees unless stated, drone permits, additional sightseeing not in the itinerary, alcoholic beverages unless stated).

2.2 Hotel category, room type, and meal plan are as displayed. Hotel substitution to a same-or-higher category is permitted where the original hotel becomes unavailable; if only a lower category is available, you have the right to accept or to cancel for a 100% refund.

2.3 Number of travellers, room sharing (single / double / triple / quad), and child policy as displayed at checkout.

3. Booking confirmation and itinerary

3.1 The package is confirmed once payment is captured. You receive the final itinerary with hotel names, transport vendor, guide contact, and day-by-day schedule at least 5 days before travel start (or sooner where the lead time is shorter).

3.2 Minor itinerary adjustments (reordering of days, timing changes, alternate restaurants) are permitted; material changes (skipped destination, removed inclusion) require your consent or a refund of the affected component.

4. Group packages and minimum numbers

4.1 Some packages are sold on a fixed-departure basis with a minimum group size. If the minimum is not met, the Partner may cancel the departure and offer a full refund or rescheduling to the next departure.

4.2 For custom / private packages there is no minimum; pricing is per-package.

5. Taxes

5.1 GST is charged as displayed at checkout. The applicable rate is:

  • 5% (without ITC) for packages taxed under the tour-operator entry;
  • 18% (with ITC) for packages outside the tour-operator entry;
  • the breakdown is on your invoice.

REVIEW: counsel + CA required before launch — confirm tour-operator classification per package; the wrong classification creates back-tax and interest exposure.

5.2 TCS on overseas packages under section 206C(1G) of the Income-tax Act, 1961 is collected at the following rates:

  • 5% on consideration up to ₹7 lakh per Customer per financial year;
  • 20% on consideration above ₹7 lakh.

TCS is in addition to the package price and is reflected in your Form 26AS. You may set it off when filing your income tax return.

REVIEW: counsel + CA required before launch of any international SKU — personal liability of principal officer for under-collection of TCS under section 206C(7).

6. Travel documents

6.1 You are responsible for valid passport (6 months validity), visa, and any inoculations required by the destination.

6.2 Prayana / the Partner may assist with visa-application logistics where the package includes it. The decision to grant a visa is at the consulate's sole discretion; visa rejection by the consulate is not Prayana's or the Partner's liability.

6.3 Where the package includes flights, name spellings on tickets must match the passport exactly. Corrections after issue may attract airline fees that will be invoiced to you.

7. Hotel and on-ground service

7.1 Check-in / check-out times, child-bed availability, and meal timings are as published by each hotel. Late check-out is subject to hotel availability and may be chargeable.

7.2 You must comply with hotel rules and Indian / destination-country law. Damage to hotel property may be charged directly to you by the hotel.

8. Travel insurance

Travel insurance is strongly recommended for all Holiday Packages and mandatory for overseas packages where the destination country requires it (Schengen, USA, Australia, etc.). The package price does not include travel insurance unless expressly stated.

9. Cancellation and refund

9.1 The cancellation tier displayed on the listing applies (see Cancellation & Refund Policy).

9.2 Non-refundable third-party costs already incurred (airline tickets, hotel deposits with strict cancellation, visa fees) are excluded from refund and itemised separately on your refund statement.

9.3 Partner-initiated cancellation, including minimum-group failure: 100% refund (or reschedule at your choice).

9.4 Visa rejection: any visa fee already paid to the consulate is non-refundable; the rest of the package follows the standard cancellation tier of the listing unless the listing's policy expressly provides for visa rejection (some Prayana Packages offer a "Visa Rejection Refund" rider — look for that on the listing).

10. Force majeure

Covered by Section 9 of the Booking Terms. Government travel advisories, border closures, and consular visa-policy changes are treated as force majeure for the affected leg of the package.

11. Liability

Operational liability rests with each Partner that supplies a component (hotel, transport, guide, activity). Prayana facilitates the booking and where it acts as principal aggregator (the package SKU is a Prayana-curated product) assumes the additional aggregator role described in Section 2.3 of the Booking Terms.

For activity components that are risk-bearing (adventure, water sports), the Activity Participant Waiver applies in addition.

12. Customer obligations

You will (a) provide accurate traveller details and documents on time, (b) follow Partner and guide instructions, (c) respect destination culture, law, and environment, (d) maintain reasonable conduct that does not endanger other travellers, and (e) pay any additional charges for upgrades, extras, or damages directly to the relevant supplier on the ground.
